If I had my exhuast emissions checked to see if the sports cat if have fitted is doing its job and the car failed would the garage keep my car as it is then un-roadworthy?

Nope, as it's not dangerously unroadworthy. You can still drive a car that has failed an MOT provided your previous one is still valid. Hence the reason it makes sense to get your MOT early incase it fails on something.
